This Acceptable Use Policy (“AUP”) governs the use of the Gunly Platform and applies to all Merchants and users who access or use Gunly’s services.
1. PURPOSE OF THIS POLICY
This Acceptable Use Policy (“AUP”) describes prohibited, restricted, and unlawful activities when accessing or using the Gunly Platform. The AUP protects the integrity, security, and lawful use of the Platform, especially given the highly regulated nature of firearms and ammunition commerce.
By using the Platform, the Merchant agrees to abide by this AUP. Violations may result in suspension or termination of Services, removal of content, or other actions as determined by Gunly.
2. GENERAL RESPONSIBILITIES
Merchants are responsible for:
- Ensuring all use of the Platform complies with federal, state, and local laws
- Monitoring their account for unauthorized or unlawful activity
- Ensuring their End Customers comply with applicable firearms laws
- Providing accurate information in all listings, descriptions, and communications
- Maintaining the security of their login credentials and accounts
Gunly may investigate any suspected violation of this AUP.
3. PROHIBITED ACTIVITIES
Merchants may not use the Platform to engage in, promote, or facilitate any of the following activities.
3.1 Illegal Activities
- Violating any federal, state, or local firearm, ammunition, or weapons law
- Selling firearms without a valid FFL (if required)
- Selling ammunition or regulated items in jurisdictions where prohibited
- Selling or transferring items classified as illegal in the buyer’s jurisdiction
- Facilitating straw purchases or unlawful transfers
- Selling or advertising items that violate 18 U.S.C. § 922 or ATF regulations
- Encouraging or enabling End Customers to bypass background checks or age restrictions
- Violating export control laws, including ITAR or EAR
3.2 Restricted and Prohibited Products
Merchants may not list, sell, advertise, or facilitate:
- Machine guns (as defined by the NFA), unless legally permitted with proper licensing
- Unregistered NFA items
- Ghost gun kits or unserialized frames/receivers where prohibited
- Conversion devices (including auto sears, switches, or chips)
- Suppressors or SBR/SBS items without proper licensing and compliance
- Ammunition types prohibited in certain states (e.g., armor-piercing, incendiary)
- High-capacity magazines where illegal
- Firearm parts or accessories prohibited under state-specific laws
3.3 Fraud, Abuse, and Misrepresentation
Merchants may not:
- Falsify product information, pricing, or inventory
- Misrepresent the legal status of firearms or regulated products
- Manipulate ATF-required information or processes
- Provide false FFL information
- Attempt to defraud payment processors or circumvent their restrictions
- Engage in chargeback abuse
3.4 Harassment, Harmful, or Abusive Content
Merchants may not upload or transmit content that is:
- Threatening, harassing, or abusive
- Inciting violence or unlawful activity
- Hate speech or extremist propaganda
- Obscene or sexually explicit (unrelated to regulated weapons laws)
3.5 Security Violations
Merchants may not:
- Access or attempt to access areas of the Platform without authorization
- Penetration-test, probe, or scan the Platform without written permission
- Introduce malware, viruses, or malicious code
- Attempt to bypass Platform restrictions, security measures, or access controls
- Interfere with Platform performance or availability
3.6 Platform Misuse
Merchants may not:
- Modify, alter, or reverse engineer Platform code, themes, or configurations
- Install unapproved scripts, plugins, or third-party tools
- Perform actions that impose unreasonable load on the Platform
- Scrape, copy, or extract Platform structure or content
4. EMAIL, SMS, AND COMMUNICATION RULES
4.1 CAN-SPAM and TCPA Compliance
Merchants must comply with:
- The CAN-SPAM Act (email marketing rules)
- The Telephone Consumer Protection Act (SMS consent requirements)
Merchants may not send:
- Unsolicited commercial messages without proper consent
- Messages containing illegal offers
- Deceptive, fraudulent, or misleading communications
4.2 Abuse of Gunly Communication Tools
Merchants may not use Gunly’s communication tools to:
- Spam or mass message End Customers without authorization
- Send harassing or threatening messages
- Send communications that violate firearms advertising laws
5. FIREARMS COMPLIANCE REQUIREMENTS
5.1 Merchant Licensing Obligations
Merchants must:
- Hold a valid FFL if selling firearms requiring licensure
- Immediately notify Gunly if their FFL is suspended, revoked, or expired
- Confirm legality of all products listed in each jurisdiction served
5.2 Transaction Compliance
Merchants must:
- Validate End Customer eligibility
- Ensure firearms are shipped only to authorized FFLs
- Comply with the NICS background check process
- Follow all ATF, state, and local recordkeeping requirements
5.3 Prohibited Firearms Transactions
Merchants may not:
- List firearms for direct-to-door shipment where prohibited
- Bypass the FFL transfer process
- Sell or advertise firearms to prohibited persons
- Ship firearms across state lines unlawfully
- Ship ammunition to restricted jurisdictions
5.4 Accuracy of Legal Information
Gunly does not provide compliance advice. Merchants are solely responsible for ensuring the legality of all products, content, and transactions.
6. THIRD PARTY SERVICES AND INTEGRATIONS
Merchants must comply with the policies of all third-party services they use, including:
- Payment processors (Authorize.net, merchant gateways)
- Distributor feed providers
- Cloudflare, DigitalOcean, SendGrid, Twilio, HubSpot, and other subprocessors
Merchants may not:
- Circumvent payment processor restrictions on firearms or regulated products
- Attempt to use unsupported or prohibited integrations
7. ENFORCEMENT AND REMEDIES
Gunly may take any of the following actions, in its sole discretion, if it believes a Merchant has violated this AUP:
- Issue warnings or require corrective action
- Remove or disable access to content
- Suspend or limit account functionality
- Disable Merchant storefront
- Terminate the Merchant’s account immediately
- Report unlawful activity to authorities or regulators
Gunly is not required to provide advance notice before taking enforcement action.
8. CHANGES TO THIS POLICY
Gunly may update this Acceptable Use Policy at any time. Continued use of the Platform constitutes acceptance of the updated Policy.
